These Terms of Service (“Terms”) are a legally binding agreement between Mana Marketing LLC, doing business as Apex (“Apex,” “we,” “us,” or “our”), and the individual or entity accessing or using the Services (“Customer,” “you,” or “your”).

These Terms govern your access to and use of:

• The Apex software platform;
• Apex applications, plugins, integrations, APIs, dashboards, page-building tools, experimentation tools, analytics, artificial-intelligence features, and related functionality; and
• Any other products or services that reference these Terms,

collectively, the “Services.”

By creating an account, purchasing a subscription, connecting a store, clicking to accept these Terms, or otherwise accessing or using the Services, you agree to be bound by these Terms.

If you use the Services on behalf of a company or other organization, you represent that you have the authority to bind that organization to these Terms. In that case, “Customer,” “you,” and “your” refer to that organization.

If you do not agree to these Terms, do not access or use the Services.

1. Business Use

The Services are intended for use by businesses and individuals acting in a professional or commercial capacity. They are not intended primarily for personal, family, or household use.

You represent that:

1. You are at least 18 years old;
2. You have the legal capacity to enter into these Terms;
3. You are using the Services for business purposes; and
4. If you act on behalf of an organization, you are authorized to bind that organization.

Apex provides software designed to help ecommerce businesses analyze, create, personalize, test, and improve customer purchase experiences.
